U.S. immigration for skilled workers:The Main Green Card Routes for Foreign Workers
1. EB-1A — Extraordinary Ability
This is one of the most talked-about employment-based green card categories, but it is also one of the easiest to misunderstand.
The EB-1A category is for people who can demonstrate extraordinary ability in areas such as the sciences, arts, education, business or athletics.
And no, simply being “very good” at your job is not enough.
USCIS describes this category as applying to people who have risen to the top of their field and can demonstrate sustained national or international acclaim. One important feature of this one is that an employer job offer is not required for an EB-1A petition.
And that can make this pathway particularly interesting for:
* Researchers
* Scientists
* Entrepreneurs
* Artists
* Athletes
* Business professionals
* Technology specialists
* Academics
But the evidence matters.
Awards, publications, media coverage, judging the work of others, significant contributions and other qualifying evidence may become relevant depending on the case.
This is not the “I have 10 years of experience” green card.
You need evidence that distinguishes you from the ordinary professional in your field.
2. EB-1B — Outstanding Professors and Researchers
If your career is in academia or research, this category may be worth investigating.
EB-1B is designed for outstanding professors and researchers who meet the applicable requirements.
Unlike EB-1A, this route generally involves an employer.
So a university, research institution or qualifying employer may play an important role in the process.
This can be relevant to people working in:
_ Universities
_ Research institutes
_ Scientific organizations
_ Certain private research environments
And If you have built a serious research profile, you don’t automatically assume that EB-2 is your only possible route.
Sometimes the better question is:
“Which employment-based category best matches the evidence I have already built?”
